MT Sobek Digital Services Terms of Use

Effective Date: July 1, 2026

Acceptance of Terms

By accessing or using the MT Sobek website, booking platforms, digital resources, and our AI chatbot assistant “Scout by MT Sobek” (collectively, the “Digital Services”), you agree to be bound by these Terms of Use. If you do not agree, you must immediately cease using all MT Sobek Digital Services.

These Terms of Use govern your use of MT Sobek’s website and AI tools. Trip bookings and tour participation are governed by the MT Sobek Terms & Conditions. Personal data is governed by the MT Sobek Privacy Statement. These documents apply to guests who use Scout by MT Sobek to research or plan a trip.

Nature of Scout by MT Sobek

Automated Interaction: Scout by MT Sobek is an automated system powered by artificial intelligence. No human operator is involved.
Information Only: All information, suggestions, and/or trip details provided by Scout by MT Sobek are for informational purposes only. Scout by MT Sobek does not provide medical, legal, financial, or physical safety advice.
No Booking Guarantees: Conversations with Scout by MT Sobek do not constitute a contract, final quote, or guaranteed availability. Actual bookings must be confirmed through an authorized MT Sobek representative or online checkout process.

Disclaimer of Warranties

“As-Is” Delivery: All Digital Services, including Scout by MT Sobek, are provided on an “As-Is” and “As-Available” basis.
Accuracy Warning: Generative AI tools are subject to errors, hallucinations, and outdated information. MT Sobek makes no warranties regarding the accuracy, completeness, or reliability of content generated by Scout by MT Sobek.
Independent Verification Required: You are solely responsible for verifying all information from Scout by MT Sobek before making travel, financial, or booking decisions.

Limitation of Liability

To the maximum extent permitted by applicable law, MT Sobek shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Digital Services.

This limitation, among other things, applies to the following: itinerary or pricing errors from Scout by MT Sobek; misinterpretation of trip difficulty; and data transmission failures or service interruptions.

For claims arising solely from Scout by MT Sobek responses, liability is limited to re-performance of the relevant digital service. Claims arising from bodily injury, death, inconvenience and/or loss of property on a booked trip are governed exclusively by the MT Sobek Terms & Conditions.

Acceptable Use

You agree to interact with the Digital Services lawfully and respectfully. You may not:

Submit profane, abusive, harassing, or discriminatory prompts.
Attempt to jailbreak, reverse-engineer, or inject malicious code into Scout by MT Sobek or anywhere else on MT Sobek’s website.
Input sensitive personal data such as Social Security numbers, medical information, or payment card details into the chat interface. A disclosure notice at the start of each session reminds users of this. Any data inadvertently submitted will be handled per the MT Sobek Privacy Statement and the Data Processing Addendums of our chatbot provider and our Customer Relationship Management (CRM) platform.
Scrape or distribute data generated by our systems for commercial use or to train competing AI models.

Use of Chat Data

Session Disclosure: The following notice is displayed to all users at the start of every Scout by MT Sobek session. Continued use of Scout by MT Sobek following this disclosure constitutes acknowledgment and acceptance of its terms:

Scout by MT Sobek is an automated AI assistant powered by a third-party AI infrastructure provider, not a human. I can help you explore destinations, compare trips, and more — for bookings or important matters, please confirm with our team. By continuing this chat, you acknowledge that: (1) this conversation may be retained for service improvement; and (2) you should not enter sensitive personal information such as Social Security numbers, medical information or payment card details. Use of this chat is acceptance of and subject to the MT Sobek Terms of Use, Privacy Statement, and Terms and Conditions.

Chat Log Retention: MT Sobek generally retains chat history logs from Scout by MT Sobek sessions for two (2) years.

Service Improvement: MT Sobek may use chat logs to review, analyze, and improve Scout by MT Sobek’s responses and safety. Chat session data is also passed to our Customer Relationship Management (CRM) platform, which uses AI to analyze conversations for service insights. Neither our AI chatbot infrastructure provider nor our CRM platform permits customer data to be used for AI model training, as confirmed in their respective Data Processing Addendums.

Personal Data: Do not share Social Security numbers, medical information or payment card details in the chat. Any personal information you provide will be handled per the MT Sobek Privacy Statement.

Third-Party Services

Scout by MT Sobek is powered by a third-party AI infrastructure provider using large language model technology. Chat session data is also passed to our Customer Relationship Management (CRM) platform, which uses AI to analyze conversations for service insights. MT Sobek does not warrant or assume liability for the functionality, security, or uptime of these third-party platforms. Each provider’s Data Processing Addendum governs the handling of personal data processed through these platforms. Details are available upon request by contacting [email protected]. Additional third-party digital service providers include: web analytics (Google Analytics, etc.), cloud hosting, booking/reservation platforms, and email marketing services. Internal Use of AI

MT Sobek team members may use AI tools internally for operational analysis and business improvement. Our internal policy requires that guest personal information be anonymized or removed before being submitted to any AI tool. In the event that personal data is inadvertently included in an internal AI query, that data will be handled in accordance with the applicable vendor’s Data Processing Addendum and our Privacy Statement.

Revisions

MT Sobek may modify these Terms of Use at any time. Continued use after updates are published constitutes acceptance of the revised Terms of Use.

Binding Arbitration and Governing Law

Any dispute concerning, relating or referring to these Terms of Use shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§ 1-16, pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) California law without consideration of the California Arbitration Act and will take place in San Francisco, California. The arbitrator and not any federal, state, or local court or agency shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this Agreement, including but not limited to any claim that all or any part of this Agreement is void or voidable. BY AGREEING TO THESE TERMS, BOTH YOU AND MT SOBEK WAIVE ANY RIGHT TO A TRIAL BY JURY. YOU AND MT SOBEK AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, AND/OR REPRESENTATIVE PROCEEDING.

If you are located in the European Union or the United Kingdom, your use of the Digital Services and any personal data collected is subject to the EU’s General Data Protection Regulation ( GDPR) and the UK’s GDPR respectively. Data transfers to the United States are made under appropriate safeguards including the Standard Contractual Clauses of our chatbot provider and our CRM.
